These Terms of Service ("Terms") govern your access to and use of the services provided by ArrayStory Limited ("we", "our", or "us"). By accessing or using our services, you agree to be bound by these Terms.

These Terms are legally binding and enforceable. If you do not agree to these Terms in their entirety, you must immediately cease all use of our services and may not access or use any of our products, services, or platforms.

We reserve the right to modify these Terms at any time, and such modifications shall be effective immediately upon posting. Your continued use of our services after any modifications constitutes your acceptance of the modified Terms. It is your responsibility to review these Terms regularly.

By creating an account, purchasing a product, downloading software, accessing our website, or using any of our services in any manner, you acknowledge that you have read, understood, and unconditionally agree to be bound by these Terms, our Privacy Policy, and all applicable laws and regulations.

You must be at least 18 years old and have the legal capacity to enter into binding contracts to use our services. If you are under 18, you are strictly prohibited from using our services, and any account created by a minor will be immediately terminated without refund.

You represent and warrant that all information provided to us is accurate, current, and complete. Providing false, misleading, or incomplete information constitutes a material breach of these Terms and will result in immediate account termination.

You may only create one account per person or entity. Creating multiple accounts, using false identities, or attempting to circumvent account restrictions is strictly prohibited and will result in immediate termination of all associated accounts.

You may use our services only for lawful purposes and in accordance with these Terms. You agree not to:

• Violate any applicable local, state, national, or international laws or regulations
• Infringe upon the intellectual property, privacy, or other rights of others
• Transmit, upload, or distribute any harmful, offensive, illegal, defamatory, or objectionable content
• Attempt to gain unauthorized access to our systems, networks, or accounts
• Interfere with, disrupt, or damage our services, servers, or networks
• Use our services to compete with us, reverse engineer our products, or create competing products
• Resell, redistribute, or share your account or license with others
• Use automated systems, bots, scrapers, or scripts to access our services without authorization
• Circumvent or attempt to circumvent any security measures, licensing restrictions, or usage limitations
• Engage in any activity that could harm our reputation, business, or relationships with other users

You are strictly prohibited from using our products, services, or projects for any of the following purposes:

• Adult content, nudity, or any sexually explicit material
• LGBTQ activities or content
• Terrorism activities or content that promotes terrorism
• Promoting, supporting, or facilitating any of the above prohibited activities

To access certain features of our services, you must create an account. Account creation requires valid email verification and may require additional identity verification at our discretion. You are solely and completely responsible for:

• Maintaining the absolute confidentiality and security of your account credentials
• All activities, transactions, and content associated with your account, regardless of who performs them
• Providing accurate, current, and complete information during account creation and keeping it updated
• Immediately notifying us of any unauthorized access, use, or security breach of your account
• Ensuring that your account information does not violate any third-party rights

We reserve the absolute right to suspend, terminate, or restrict your account immediately, without notice or refund, if you violate these Terms, engage in fraudulent activity, provide false information, or engage in any activity we deem harmful to our business or other users.

Account sharing, transfer, or sale is strictly prohibited. Your account is personal and non-transferable. Any attempt to transfer, sell, or share your account will result in immediate permanent termination.

All content, features, functionality, code, designs, trademarks, logos, graphics, images, audio, video, text, software, and any other materials associated with our services are the exclusive property of ArrayStory Limited or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are strictly prohibited from reproducing, distributing, modifying, creating derivative works, reverse engineering, decompiling, disassembling, publicly displaying, publicly performing, republishing, downloading, storing, transmitting, selling, licensing, sublicensing, or otherwise exploiting any of our content without our explicit prior written consent.

When you purchase a license for our products, you receive a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use the product solely in accordance with the license terms provided with the product. This license is personal to you and may not be transferred, assigned, or shared.

Any unauthorized use of our intellectual property constitutes infringement and may result in immediate termination of your license, legal action, and claims for damages including but not limited to lost profits, statutory damages, and attorney fees.

Pricing and Payment

All prices are stated in the currency displayed on our website. We reserve the right to change our prices at any time, but price changes will not affect purchases already completed.

Payment must be made at the time of purchase using one of our accepted payment methods. By providing payment information, you represent and warrant that you are authorized to use the payment method provided.

Subscriptions

If you purchase a subscription, you will be charged automatically on a recurring basis according to your selected billing cycle (monthly or yearly). Subscriptions will continue until cancelled by you or terminated by us.

You may cancel your subscription at any time through your account dashboard or by contacting our support team. Cancellation will take effect at the end of your current billing period.

Due to the digital, downloadable, and immediately accessible nature of our products, ALL SALES ARE FINAL. We do not offer refunds, returns, or exchanges under any circumstances once a product has been purchased, downloaded, or accessed, except as required by mandatory applicable law.

By purchasing our products, you acknowledge and agree that:

• You have reviewed all product descriptions, features, and requirements before purchase
• You understand that digital products cannot be "returned" in the traditional sense
• You waive any right to a refund except where legally mandated
• You accept the product "as is" and "as available"

In the extremely rare case where a refund may be legally required (such as duplicate charges due to technical errors), you must contact us within 7 days of purchase with complete order details and proof of the error. Refund decisions are at our sole and absolute discretion, and we are under no obligation to provide refunds.

We reserve the absolute right to terminate, suspend, restrict, or limit your access to our services immediately, without prior notice, explanation, or liability, at any time and for any reason, including but not limited to:

• Any violation of these Terms, no matter how minor
• Suspected fraudulent, illegal, or harmful activity
• Providing false or misleading information
• Non-payment or payment disputes
• Any activity that we determine, in our sole discretion, is harmful to our business, reputation, or other users
• Extended periods of account inactivity

Upon termination, your right to use our services, access your account, and use any licensed products will cease immediately and permanently. All licenses granted to you will be automatically revoked. You must immediately stop using all our products and services.

Termination does not entitle you to any refund, credit, or compensation of any kind. All fees paid are non-refundable upon termination, regardless of the reason for termination.

If you wish to terminate your account voluntarily, you may do so by contacting our support team or using the account deletion feature in your dashboard. However, termination does not relieve you of any obligations or liabilities incurred prior to termination.

All provisions of these Terms that by their nature should survive termination shall survive indefinitely, including but not limited to ownership provisions, warranty disclaimers, limitations of liability, indemnification obligations, and payment obligations.

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

• Our services will be uninterrupted, secure, or error-free
• Defects will be corrected
• Our services are free of viruses or other harmful components
• The results obtained from using our services will meet your requirements

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by applicable law, in no event shall ArrayStory Limited, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use our services
• Any unauthorized access to or use of our servers or any personal information stored therein
• Any interruption or cessation of transmission to or from our services
• Any bugs, viruses, trojan horses, or similar that may be transmitted through our services
• Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content

Our total liability to you for all claims arising from or related to the use of our services, regardless of the legal theory, shall not exceed the lesser of: (a) the amount you paid to us in the twelve (12) months preceding the claim, or (b) one hundred dollars ($100).

In no event shall we be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, even if we have been advised of the possibility of such damages. This limitation applies regardless of the legal theory on which the claim is based, including contract, tort, negligence, strict liability, or otherwise.

You agree to defend, indemnify, and hold harmless ArrayStory Limited, its parent companies, subsidiaries, affiliates, directors, officers, employees, agents, partners, suppliers, licensors, and successors from and against any and all claims, demands, actions, suits, proceedings, liabilities, damages, losses, costs, and expenses (including without limitation, reasonable attorney's fees, court costs, and expert witness fees), whether known or unknown, arising out of or in any way connected with:

• Your access to, use of, or inability to use our services
• Your violation or alleged violation of these Terms or any applicable law
• Your violation or alleged violation of any third-party right, including without limitation any intellectual property, privacy, publicity, or contractual right
• Any content you submit, post, transmit, or make available through our services
• Your interaction with other users or third parties through our services
• Any unauthorized use of your account or credentials
• Any dispute between you and any third party relating to our services

This indemnification obligation will survive termination of these Terms and your use of our services. You agree to cooperate fully in the defense of any claim subject to indemnification. We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you, at your expense.

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the courts of England and Wales.

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use our services after any revisions become effective, you agree to be bound by the revised terms.

If you do not agree to the new terms, you must stop using our services.

We actively monitor all use of our services to ensure compliance with these Terms. You consent to such monitoring and acknowledge that we may use automated systems, third-party services, and manual review to detect violations.

We reserve the right to investigate any suspected violation of these Terms, including but not limited to reviewing your account activity, content, and usage patterns. You agree to cooperate fully with any such investigation.

We may, at our sole discretion, require additional verification, documentation, or information from you at any time. Failure to provide requested information may result in immediate account suspension or termination.

Violation of these Terms may result in one or more of the following enforcement actions, at our sole discretion:

• Immediate and permanent termination of your account and all licenses
• Revocation of access to all products and services without refund
• Legal action seeking injunctive relief, damages, and attorney fees
• Reporting violations to law enforcement or regulatory authorities
• Public disclosure of violations where legally permitted
• Permanent ban from all current and future ArrayStory services

We are under no obligation to provide warnings before taking enforcement action. Enforcement actions are final and non-negotiable.

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions of these Terms will remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, it shall be severed from these Terms.

These Terms, together with our Privacy Policy and any additional terms referenced herein, constitute the entire agreement between you and ArrayStory Limited regarding our services and supersede and replace any prior or contemporaneous agreements, understandings, or communications, whether written or oral.
